Automatic Brewers SARL is a reputable manufacturer and trader of coffee products and related goods and services. (Referred to hereinafter as “A.B.”)

And

Has developed and owns a website with a domain name www.barista-espresso.com and a Mobile app (My-barista, Mybarista) both referred to hereinafter as “A.B. web services”

The following Terms and conditions are set for the mentioned website/mobile app and are binding for all “A.B. web services” users’ visitors and downloaders (Referred to as “User(s)”), including but not limited to all links, application, pages, etc..

 

Website Role identification:

 

This website is published for marketing and advertising purposes and is not intended to disclose any audited or scientific fact(s).

 

Opening Hours

“A.B.” opens from Monday to Friday from 8 am till 5 pm (Beirut local time).

“A.B.” may close on Lebanese public holidays.

 

Services provided on the website:

 

“A.B.” does not commit to grant any “User(s)” the unconditional right to benefit from the services offered by “A.B. web services”.

 

“A.B.”, upon its own full discretion, with or without a valid reason, maintains the rights to exclude/refuse/delay “User(s)”and or potential “User(s)” from “A.B. web services”, or from any other platform whatsoever.

 

Not to create any ambiguity the services provided shall abide by the following terms

Purchasing of Goods/Services:

Upon “User(s)” request to purchase any of the product/service, “A.B.” will study the request and check if the product/service is available on stock and if “A.B.” has the interest to conclude the deal.

A confirmation E-mail or official order confirmation accepting the purchase request shall be sent to the user.

“A.B.” may proceed in delivering the goods in a reasonable time to a third party in order to deliver the goods to the end user.

If the user chooses to pay for the goods by “upon delivery” method, then “A.B.” shall deliver the goods and shall pay for delivery charges and considers the agreement as fulfilled, if “User(s)”defaults in payment upon delivery, The delivery of goods will be cancelled and the goods may be returned, and additional charges (Minimum of 200 USD) on the “User(s)” shall apply.

“A.B.” will not be responsible of the goods sold after delivery

Coffee solutions:

Upon “User(s)” request to purchase any Coffee service, “A.B.” will study the request and check if the product/service is available on stock and if “A.B.” has the interest to conclude the deal.

If yes, a confirmation E-mail or official order confirmation accepting the request shall be sent to the user.

Additional terms and payments’ agreements may be required accordingly

. Catering services:

Upon “User(s)” request for any catering service, “A.B.” will study the request and check if the product/service is available on stock and if “A.B.” has the interest to conclude the deal.

A confirmation E-mail or official order confirmation accepting the purchase request shall be sent to the user.

Additional terms and payments’ agreements may be required accordingly Maintenance:

Upon “User(s)” request for a Maintenance Service, “A.B.” will study the request and check if the product/service is available on stock and if “A.B.” has the interest to conclude the deal.

A confirmation E-mail or official order confirmation accepting the request shall be sent to the user.

Additional terms and payments’ agreements may be required accordingly

Job Application:

Upon “User(s)” submitting a Job Application, “A.B.” may study and check the application and may disregard the application with or without a valid reason, and without notifying the applicant.

Requesting to be a distributor B2B:

Upon “User(s)” submitting Request to become a distributor, “A.B.” may study and check the request and may disregard the request with or without a valid reason, and without notifying the applicant.

Participating in the training programs:

“A.B.” conduct training programs occasionally, and upon “User(s)” submitting Request to participate in the training programs, “A.B.” may study and check the request and may disregard the request with or without a valid reason (regardless if there is a vacancy or not) , and without notifying the applicant.

“A.B.” may contact the “User(s)” to confirm availability of training sessions and arrange for the “User(s)” participation.

Additional terms and payments’ agreements may be required accordingly

Communication:

 

Agents receiving information through the communication channels mentioned in the website may not be employees of “A.B.” AND may not have the authority to resolve any issue or have any delegation to receive information or to grant any binding obligation or promise.

Any customer support given through the website communicating channels are non-binding and may not be accurate, they should be revised by the “User(s)” to assure its compliance with technical specification and legal rules in the receiving country prior to use.

Prices and services:

The company commits to sell the mentioned goods/services, in the normal conditions it sells other customers.

Prices mentioned on any product are the selling prices of the company, additional taxes, extra delivery or custom charges may be requested.

Payment

Online Payment service is made by third parties.

“A.B.”, shall not be responsible for any loss or damage incurred by any user upon or during or related to any payment online.

Refund Policy:

In case the products delivered were damaged or were not received as ordered/ requested, the buyer should inform the company within 48 hours of the receiving/ delivery date , if the damage is the responsibility of the Selling Company, the company shall provide a replacement for the damaged product as long as the goods requested are available on stock or any other resolution might be agreed on, delivery will not be part of any remedy, and charges might arise

 

Sales commitment:

No transaction or deal is concluded unless the user receives a confirmation from official source stating that the purchase order is accepted and goods are available on stock, yet the delivery dates are uncertain and may vary. Orders that have been sent via the “A.B. web services” cannot be cancelled for any reason, even if the purchase order is not confirmed and/or the goods aren’t delivered yet.

Delivery Policy:

Delivery is made by a third party.

“A.B.” will not be held responsible for any delay or default in Delivery, “A.B.” responsibility ends upon the selling procedure and confirmation of purchase order and providing the goods to the delivery Company.

The product will be delivered within 2 to 4 working days in Lebanon unless any inconvenience might arise and it may be communicated with the buyer; a longer delivery period is requested abroad and will depends on the country of delivery and regulations while providing necessary information such as address, any documents needed, etc…

Contact address:

Contact details published through the “A.B. web services” do not disclose the legal domicile of the company, as the mentioned addresses are for marketing purposes.

All legal complaint(s) and/or communication(s) should be sent to the legal registered address of “A.B.”, via a secured registered name to be delivered to the director(s) of the “A.B.” Any Legal notification should be sent to the registered legal address in Lebanon Dekwaneh, Midan Street.

Information published via “A.B. web services”:

“A.B. web services” directors, owners and/or publishers make no representation, warranty, or guarantee of any kind with respect to the accuracy, completeness or correctness of the Information or of the achievement or reasonableness of future projections, management targets, prospects or returns, if any, and will not have any liability to the Recipient as a result of its reliance on or use of any Information published on the “A.B. web services”

All photos, “A.B. web services” content, logos, and information data are protected by intellectual property and copyright laws and can’t be used by any other party without the full approval of the company. Using any element from “A.B. web services” is strictly prohibited.

 

Third Party Services

The company is not responsible for any third party services /websites linked to/ accessed from the “A.B. web services”

“User(s)” shall Discharge “A.B.” from any responsibility regarding any damages occurring due to third parties

Damages:

“User(s)” discharge “A.B.” from any professional liability and from any product liability as the goods purchased via “A.B. web services” may be delivered via third parties and may get damaged, and “User(s)” took knowledge that all offered service is made for marketing and leisure.

“User(s)” discharge “A.B.” and its workers, managers, board members, auditors, consultants, shareholders or owners from any claim or from any demand whatsoever regarding any damage whatsoever on “User(s)” or any of their accompanies or any of the assets, possessions, resources, valuables etc.. that “User(s)” or their accompanies may lose (Accompanies are not allowed by “A.B.”). In all other cases that “A.B.” or any of its workers, managers, board members, auditors, consultants, shareholders or owners may be responsible, “A.B.” shall never be obliged to pay any additional value for any reason whatsoever exceeding the amount received by “A.B.” after deducting all taxes and costs and charges paid by “A.B.”.

In any possible case, “A.B.” shall not be obliged to pay damages to any party more than the profit (If any) gained from the direct incident causing the damage.

“User(s)” failing or refusing to pay purchased goods shall pay a minimum of 200USD as direct damages in addition to the cost of goods and expenses paid and no mediation is requested.

“A.B.” reserves the right to claim damages from any “User(s)” for any wrong doing or from any damages caused to “A.B.” or any other party using “A.B. web services directly or indirectly.

Privacy of information:

All information shared with the “A.B. web services” is not dealt as private or confidential information (Payment details are made via a third party and shall be related to the privacy and the security policies offered by the third party).

Job offers or Job requests:

The resume / Curriculum Vitae submitted through the website or information communicated via the “A.B. web services “can be shared with other companies, and may be disregarded with or without any valid reason.

Distribution opportunities or requests:

The distribution requests sent via the website can be shared with other sister company or related entity, and may be disregarded with or without any valid reason.

Legal Conflict:

In case of any conflict against “A.B.”, Downloaders and/or users should try to resolve any conflict through mediation for a period of 12 months to solve the problem (Downloaders and/or users should inform all their claims and demand all their claims officially to “A.B.” during first week of mediation), and shall be compelled to accept the offer to be paid the amount received by “A.B.” after deducting all taxes and costs and charges paid by “A.B.”. The mediator shall be appointed by “A.B.” Or shall be assigned by Beirut Bar Association. After mediation expires, all claims failed to be resolved in Mediation shall be settled by the Lebanese Courts in Beirut according to Lebanese regulations and laws.

Binding Terms

These Terms and conditions shall supersede any other agreement or promise or advertisement, and shall be binding to all “User(s)”.

“User(s)” by accepting these terms and condition assure on their full own personal responsibility that all co-users accepts and abides by these terms and conditions.
